another case of human torture upon a dalit by BSF, prevailing impunity

Name of the Victim:

Mr. Govinda Mondal, son of Late Ananta Mondal, aged about-35 years, by faith-Hindu, by Caste-Schedule Caste, residing at village-Char Rajapur, Post Office- Char Rajapur, Police Station- Raninagar, Sub Division- Domkol, District- Murshidabad.


Name of the Perpetrator(s) :

(1) Mr. Tutu Ustad (Constable of Char Mou Rashi Border Out Post of ‘E’ Company under Battalion Number-52 of Border Security Force; ( 2) Two unknown constables of Char Mou Rashi Border Out-Post of ‘E’ Company under Battalion Number-52 of Border Security Force; (3) Mr. Pabitra Mitra Mustafi, Officer-in-Charge of Raninagar Police Station.


Place of Incident:

At the mud-built house (Bathanbari) of Mr. Bishu Mondal


Date and Time of the Incident:

On 6th August, 2010 at about 2.20 PM.


Case Details:

Mr. Govinda Mondal possesses about 4-5 Bighas of cultivation land. He produces jute on his land. But the income from his farming land is meager to run his family very poorly. Due to his poor economical condition he sometimes used to smuggle medicine (Phensidyl). It was revealed in our fact finding that on 6th August 2010 at around 2.20 PM Mr. Govinda Mondal went to his own farming land with intention to smuggle medicine. After reaching his farming land he gave a call from a mobile phone to Mr. Sanjay Mondal and reportedly told him to send the medicine (Phensidyl). At that time the constables of Char Mou Rashi Border Out-Post of ‘E’ Comoany under Battelion Number-52 of BSF there near the mud-built house (Bathanbari) of one Bishnu Mondal and they saw him talking on the phone. He was soon caught by those BSF Constables. Those BSF constables grabbed his mobile phone set first and then dragged him to the said mud-built house (Bathanbari) of Mr. Bishu Mondal. After that those BSF constables took off his wearing cloth and forcibly put it into his mouth and then started to assault him brutally and indiscriminately on his feet and the whole body by the wooden handle of a spade. Those BSF constables gave countless kicks on the victim’s chest and face too. After one and half hour of continuous torture, Mr. Govinda Mondal lost his sense. At that time those BSF constables left that place without concerning about the physical condition of Mr. Govinda Mondal. After the departure of BSF personnel, two persons namely Mr. Bijay Mondal son of Mr. Bishu Mondal and Mr. Byava Sarkar son of Mr. Shyamapada Sarkar brought the victim to his home on their shoulder.


On the same day Mr. Govinda Mondal was admitted in the Lalbagh S.D Hospital as his health condition rapidly degraded. He was under treatment in that hospital from 6th August 2010 to 10th August 2010.


On 13th August 2010 MASUM conducted a medical camp in Jalangi where Mr. Govinda Mondal was checked by specialist doctors and got the necessary medicine without any cost.


On 14th August 2010 victim lodged a complaint against those BSF constables in Raninagar Police Station and police thereby registered one First Information Report on the basis of his complaint vide Raninagar Police Station Case no. 418/10 dated 14th August 2010 under sections 341(Wrongfully restraining any person) / 323 (Voluntarily causing hurt)/325 (Voluntarily causing grievous hurt) / 34(Common intention) of Indian Penal Code. But till now the victim has no idea on the progress of investigation though it is revealed in our fact finding that no one amongst the accused BSF personnel has been arrested by the police till date nor any police officer came to the village to enquire the matter.
