Two cases of torture by BSF & impunity

CASE-01

Name of the victim:- Mr. Mofijur Rahman, son of Mr. Abdul Ohab, by faith-Muslim, aged about- 25 years, residing at village- Sarandazpur, Police Station-Raninagar, District-Murshidabad, West Bengal, India.

Name of the perpetrators: - the on-duty two BSF jawans of BSF Out-Post point no.4, Kaharpara, Battalion no.-91, Police Station-Raninagar, District-Murshidabad.

Place of incident: - Inside the agricultural lands of the victim situated at Dag no. 216 and 241, Khatian no. 9060(new 366), Mouza- Katlamari and Police Station-Raninagar, District-Murshidabad

Date & time of incident: - On 27.3.2011 at about 9 am

Case Details:- It is revealed during our fact finding that the victim has agricultural lands at Dag no. 216 and 241, Khatian no. 9060(new 366), Mouza- Katlamari and Police Station-Jalangi. On 27.3.2011 at about 9 am the victim went to the said agricultural lands for the purpose of give water on the lands. He showed his voter identity card (being no. LPG 2557585) to the on-duty BSF jawans of BSF Out-Post point no.4 and entered into the agricultural lands. Then after a while again two on-duty BSF jawans of BSF Out-Post point no.4 came into the agricultural land of the victim and asked him to show his voter identity card. The victim again showed his voter identity card to them. Then suddenly the said BSF jawans started to beat the victim by their wooden sticks without disclosing any reason. The victim as a result of the beating sustained severe injuries on his body. After the said BSF jawans left the place, the victim came to his house and went to Raninagar Police Station to register complaint against the perpetrator BSF jawans. The police took the written complaint petition from the victim, but did not register any First Information Report against the perpetrator BSF jawans. The police only recorded the matter in General Diary Entry (GDE) Book vide G.D.E. no. 1331/2011 dated 27.3.2011 and just referred the victim to Godhanpara Primary Health Centre for medical treatment upon issuing one written note. The victim was medically treated at Godhanpara Primary Health Centre.

The victim is at present under medical treatment. He is also awaiting police action against the perpetrator BSF jawans, but till date there has been no investigation from the side of police into the incident.

It is also revealed during fact finding that newly posted Battalion-91 of BSF in the area where the victim resides near Indo-Bangladesh imposed various norms at their whims which restricts the free movements of the civilians residing near the border. One of such norms which the villager has to follow is that they have to show their voter identity card to BSF before entering into their agricultural lands located near border and slightest violation of such norms leads to severe torture upon the villagers.

CASE-02

Name of the victim: -Mainul Molla, son of late Mahatab Molla, aged about-32 years, by faith-Muslim, by profession- Cultivator, resided at village-Lalkup, Post Office-Bamnabad, Police Station-Raninagar, District-Murshidabad, West Bengal, India

Name of the Perpetrators: - Two on-duty Border Security Force jawans posted on 07.03.2011 at about 9:45 am under Out post-IV Bamnabad BSF Camp of Battalion-119, Police Station-Raninagar, District-Murshidabad.

Time and Date of incident: - 7/03/2011 at about 7:00 am.

Place of incident: - Near Out post IV under Battalion Number 119 Bamnabad BSF camp.

Case Details:- On 7.03.2011 at about 7 am the victim Mr. Mainul Molla while returning home after doing manual processing of lentils with Mr. Saiful Islam, a sharecropper of his land, restrained by two of the BSF jawans posted at Out post-IV Battalion-119 BSF camp without any justification. Without asking any question the on-duty BSF jawans of the said BSF Out-Post soon pulled him by the collar of his shirt and apprehended the victim & his companion. It is reported that the BSF jawans started to beat the victim mercilessly. They refused to hear any words from him. The victim received injuries on his ear and chest. Even they had torn the collar of his shirt. Then when the victim showed them his voter’s identity card they released him at about 9:45 am. It must be noted in this context that the brother of victim Mintu Molla was killed by the BSF in the year 2006. Mr. Mainul Molla himself filed a written complaint at the Raninagar Police Station the number of GDE which is 328 dated 7.3.2011. When our fact finding team asked the Sub Inspector of Raninagar Police station about this case he replied that the written complaint has been received by the police and the investigation is going on. The victim however is still suffering from extreme bodily pain due to the injuries caused by the BSF. It is relevant here to mention that the Out post IV under Battalion Number 119 Bamnabad BSF camp was situated approximately within 7 kilometers from the international border, in the village which is absolutely unlawful. It was alleged by many of the villagers that torture by BSF jawans has become a day-to-day issue there.
