One muslim man inhumanly tortured by BSF, fractures in both hands

Particulars of the victim:- Mr. Abdus Salam Mondal, son of Mr. Aulad Hossain, aged about-45 years, by faith-Muslim, residing at village-Sarandajpur, Police Station-Raninagar, District-Murshidabad, West Bengal, India.

Particulars of the perpetrators:- (1) The Camp-in-Charge of Kaharpara BSF BOP Company Head Quarter, Police Station-Raninagar; (2) Two BSF Constables of Out-Post no.4 under Kaharpara BSF BOP Company Head Quarter, Police Station-Raninagar, District-Murshidabad

Place of incident: - At BSF Out-Post no.4 under Kaharpara BSF BOP Company Head Quarter, Police Station-Raninagar, District-Murshidabad.

Date & time of incident: - On 19.5.2011 at about 9 am

Case Details:-

It is revealed during our fact finding that on 19.5.2011 in the morning hours the victim went to his farming land situated Dag no. 2919, Khatian no. 3784, Mouza- Majherdiar, Police Station- Raninagar, District-Murshidabad to spray pesticide on the crops. After doing the job, he left the farming land and started to return home. At about 9 am he crossed BSF Out-Post no.4 under Kaharpara BSF BOP Company Head Quarter. At that time BSF jawans of the said BSF Out-Post called the victim from behind. But the victim could not hear his call at that time. Immediately then two BSF jawans of the said BSF Out-Post rushed towards the victim and caught hold his body forcibly. The said BSF jawans started to beat the victim indiscriminately by wooden sticks. The said BSF jawans particularly hit on the wrist of both hands of the victim by the sticks. As a result the victim sustained fracture on both of his hands. Moreover due to the merciless beating the victim sustained bodily pain and marks of hematoma appeared on several parts of his body. The perpetrator BSF jawans also hit the victim on his chest by their boots. The BSF jawans were visibly in inebriated condition at the time of the incident and they were constantly abusing the victim in filthy languages. The said perpetrator BSF jawans even forced the victim to consume liquor from one bottle. Due to the barbaric torture the victim almost lost his sense on the spot.

Thereafter a BSF vehicle (Maruti Gypsy Van) arrived on the place of the incident and the victim was taken to Kaharpara BSF Company Head Quarter. The victim’s relatives arrived at the said BSF Head Quarter getting information of the incident from local people. Then the victim was handed over to his family members.

After being released from the custody of BSF, Mr. Minarul Mondal, brother of the victim took him (the victim) to Godhanpara Primary Health Centre for immediate medical treatment. The attending doctor upon observing the deteriorating condition of the victim referred him to Berhampur New General Hospital for treatment. The victim was under treatment in the said hospital till 24.5.2011. The Discharge Certificate of the victim issued by the hospital recorded that the victim suffered fracture on his both hands. The victim is still undergoing medical treatment. He is now being treated by our doctors under guidance of United Nations Voluntary Fund for Victim of Tortures (UNVFVT).

The victim submitted one written complaint at Raninagar Police Station disclosing the incident in details and the victim the complaint sought for legal action against the perpetrator BSF jawans. But the police did not record the acceptance of the said written complaint and also did not initiate any sort of investigation into the matter.
